neighbours playing music loudly between 3.30 a.m. and 7.30 a.m.

Hi Officer Rob,

 

Just wanted to ask what your advice is when one lives in a condo and has an inconsiderate neighbour who plays their music between 3.30 a.m. and 7.30 a.m.  I'm assuming that this person's time clock is different from the rest of the world's.

 

What are the steps to take and at what point does one call 416-808-2222?

First I don't know how I missed your question but I did so let me apoligize for my late response, The City of Toronto's Noise Bylaw as it pertains to residents is 24 hours a day.  If you are being disturbed by a neighbour's noise in the middle of the night please feel free to call the radio room at (416) 808-2222 and keep in mind that all our calls are handled on a priority basis and noise complaints are near the bottom of the list but on a slow night they do get responded to.

 

If it is an ongoing issue please feel free to contact our Community Response Unit at (416) 808-5519 as they deal with ongoing community issues.

What's in your condo's rules? There's probably something there about noise. Have you told your neighbour that his music is disturbing you? Maybe you should take the issue to condo management first?

This question is on behalf of someone else in the building.

 

I too have had this happen to me.  Hearing Janet Jackson through the walls at 1.00 a.m. was just too much.  I got dressed and went to knock on the neighbour's door.  When he saw me standing there, I didn't have to say anything.  He knew that the music was too loud and there has been no issue.

 

I can't answer for my other neighbour who is now dealing with noise.  The condo management and board are aware of the problem.

What is the 24 hour bylaw pertaining to residents? And how is it enforced? Do residents have any rights?

 

I think noise is definitely an issue when you live in a condo, apartment, or semi. I live in a semi and it's hit or miss when or how loud my neighbours will be on any given day.

 

A public education campaign on courtesy and noise reduction might not be a bad idea.

 

Headphones are a great invention.

It helps to know one's neighbours and to establish good relations with them.  But this isn't always going to be possible. When I was living in a house in the area, the people next door were renters.  At any one time, there had to have been 5 college boys there and it was awful.  They were often drunk. After parties, I would find cigarette butts that had been tossed into my backyard.  Other neighbours complained that these guys were also urinating onto their property.

 

I met the landlord one day and explained to him that his tenants were wrecking the peace on the street.  He was great and spoke to them.  Within an hour, these guys had picked up their trash and were more aware of the fact that I would be contacting their landlord again if there were issues.

 

Not fun and I was grateful when they finally moved because the landlord decided to sell the property.


We are the ones who deal with residential noise issues, and of course people do have recourse when it comes to noise issues as it can progress from a caution to tickets to criminal charges if need be. Ideally we try to reslove the issue before it gets this far.

I have had neighbours complain about my live music at 4pm in the afternoon, on a beautiful sunny day, while i played in my back yard.  What's aggravating: the neighbour's wife comes by wearing a ZORRO mask. It is my understanding that neigbours have a duty of tolerance to reasonsable nuissances. She threatened to call the police. What would have happened in those circumstances? Would Criminal charges be laid or Municipal infractions be laid?

 

I dunno, Otto: how loud was your music? Was it your immediate next door neighbour or someone from 4 yards away? Was it just loud enough for you to enjoy, or loud enough to scare all the birds away within a city block? Lots of information needs to be provided :-) Really, if you want to listen to your music outdoors, use your personal MP3 player with earphones. Not everybody enjoys the same music.

 

Zorro is pretty picky from what I have heard.
Mrs. Zorro is even pickier.
