On Thursday, September 3, 2009, at 6:50 a.m., police responded to an assault call in an alleyway off Leslie Street.

It is alleged that:

- a 59-year-old man was in his car, in an alley off Leslie Street, when the accused drove in,

- the accused parked his car and approached the victim,

- an argument ensued and the victim got out of his car,
